The actual lender and terms for any financing are identified in the relevant transaction documents. Submitting an application does not guarantee approval, funding, or any particular terms; each request is subject to review, diligence, approval, documentation, and availability of capital.

4. Legal Bases for Processing

Under UK data protection law, we rely on the following legal bases:

  • Performance of a contract — to create your account and provide the services you request.
  • Legal obligation — to meet KYC, AML, tax, accounting, and other regulatory requirements.
  • Legitimate interests — to operate, secure, and improve the Platform, prevent fraud, run our AI assistant, and offer relevant networking and introductions, balanced against your rights.
  • Consent — for optional features, marketing and networking communications sent by email, SMS, and messaging channels such as WhatsApp, non-essential cookies, and messaging/voice handled by our AI assistant. You may withdraw consent at any time.

5. How We Share Your Information

We do not sell your personal information. We share it only as necessary to operate the Platform and our services, including with:

  • Service providers and sub-processors who host our infrastructure, store our data, and provide the artificial-intelligence technology powering our assistant (for example, cloud hosting, database, and AI language-model providers), under contractual confidentiality and data-protection obligations
  • Other members of our network, where you are an accepted member and we facilitate relevant introductions or connections, using only the information appropriate for that purpose
  • Meta Platforms Ireland Ltd / WhatsApp, as the provider of our WhatsApp messaging channel; your use of WhatsApp is also subject to WhatsApp's own privacy policy
  • SMS and telephony providers who deliver our text messages and voice-call functionality, and the AI voice technology provider that powers our voice assistant, under contractual confidentiality and data-protection obligations
  • Financial, identity-verification, and compliance partners, to process transactions and meet KYC and AML obligations
  • Professional advisers (such as auditors, lawyers, and accountants) and legal, regulatory, or law-enforcement authorities, where required by law or to protect our legal rights
  • A successor entity, in connection with a merger, acquisition, or sale of assets, subject to this Policy

6. Automated Processing and Artificial Intelligence

Messages you send to our WhatsApp number and AI chat are handled by an automated assistant powered by artificial intelligence, which generates responses and helps with onboarding, triage, and general enquiries. This automated processing does not by itself produce legal or similarly significant decisions about you; decisions such as loan approvals, investment eligibility, and identity verification involve human review. You may contact us at any time to reach a member of our team instead of the automated assistant.

Voice calls you initiate may be answered by an AI voice assistant that transcribes your speech and generates spoken responses. As with our chat assistant, this does not by itself make decisions with legal or similarly significant effect; you can ask to reach a member of our team at any time.

7. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Platform, remember your preferences, keep you signed in, and understand how the Platform is used. Essential cookies are necessary for the Platform to function; non-essential cookies (such as analytics) are used only with your consent where required. You can control cookies through your browser settings and, where offered, our cookie preferences tool. Disabling some cookies may affect how the Platform works.

8. Data Retention

We retain personal information for as long as your account is active or as needed to provide our services and meet our legal, tax, accounting, and regulatory obligations. Short-term WhatsApp, SMS, chat, and voice-call transcripts are retained only briefly to maintain conversational continuity and are then removed. Durable preference and relationship information for members is retained until you ask us to delete it or it is no longer needed. When information is no longer required, we securely delete or anonymise it.

9. International Data Transfers

Some of our service providers and sub-processors (including certain hosting and AI technology providers) may process data outside the United Kingdom and European Economic Area. Where personal information is transferred internationally, we rely on appropriate safeguards — such as UK/EU Standard Contractual Clauses, the UK International Data Transfer Agreement, or an adequacy decision — to ensure your information remains protected.

10. Your Rights and Choices

Subject to applicable law, you have the right to:

  • Access your personal data and receive a copy in a structured, portable format
  • Rectify inaccurate or incomplete data
  • Erase your account and data ("right to be forgotten")
  • Restrict or object to certain processing, including profiling
  • Withdraw consent for optional features, marketing, or messaging at any time
  • Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects
  • Lodge a complaint with the UK Information Commissioner's Office (ICO)

11. Marketing Communications

Where you have opted in, we may send you match notifications and updates about our services, opportunities, and events by email, SMS, and messaging channels such as WhatsApp. You can opt out at any time — use the unsubscribe link in our emails, reply STOP to an SMS, use the opt-out in the relevant messaging channel, or contact info@tokenized-entertainment.com.
